Terms of servises for the ordering, purchasing, sale, and delivery of goods
This agreement between "FOP Oleksenko O.V." hereinafter referred to as "Seller" and the user of the internet site, hereinafter referred to as "Customer," is an agreement for ordering, purchasing, and delivering goods and establishes the basic terms and conditions for ordering, purchasing, and delivering goods through the website https://www.solnyshko.kiev.ua. The Buyer, acting with the purpose of purchasing the goods, accepts the terms of this purchase and sale agreement (hereinafter referred to as the "Agreement") under the following conditions.
1.1. Public offer (hereinafter referred to as the "Offer") - a public offer of the Seller addressed to an indefinite circle of persons to conclude a distance purchase and sale agreement (hereinafter referred to as the "Agreement") on the terms contained in this Offer, including all Appendices.
1.2. Order - the Customer's decision to order goods and their delivery, executed in the online store and/or a request to purchase and deliver goods.
2.1. The information provided below is an official proposal (offer) of the online store to any individual (hereinafter referred to as the Buyer) to conclude a purchase and sale agreement for goods. This agreement is public, that is, according to article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers.
2.2. In accordance with Article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the conditions of this offer, which confirms the conclusion of the Purchase and Sale Agreement on the proposed conditions below, is the fact of the order's confirmation.
2.3. By placing an Order, the Buyer confirms their agreement and unconditional acceptance of the terms of this offer (Agreement).
2.4. By entering into the Agreement (i.e., accepting the terms of this Offer (Proposed Opportunities) by placing an Order), the Buyer confirms the following:
The Buyer is fully aware of and agrees to the terms of this offer (offer); He/she gives permission for the collection, processing, and transfer of personal data on the terms defined below in the Disclaimer regarding the collection, processing, and transfer of personal data. The permission to process personal data is valid for the entire term of the Agreement and also for an indefinite period after its expiration. In addition, by entering into the Agreement, the Customer confirms that he/she has been informed (without additional notification) about the rights established by the Law of Ukraine "On Personal Data Protection," about the purposes of data collection, and also that his/her personal data is transferred to the Seller for the purpose of possible performance of the terms of this Agreement, the possibility of conducting settlements, as well as for obtaining invoices, acts, and other documents. The Customer also agrees that the Seller has the right to provide access to and transfer his/her personal data to third parties without any additional notification of the Customer, without changing the purpose of processing personal data. The scope of the rights of the Customer, as a subject of personal data, in accordance with the Law of Ukraine "On Personal Data Protection," is known and understood by him/her.
3.1. The price of each item of the Goods is indicated on the website of the Online Store.
3.2. The Seller has the right to unilaterally change the price for any item of the Goods.
3.3. In case of a change in the price of the ordered Goods, the Seller undertakes to inform the Buyer about the change in the price of the Goods.
3.4. The Buyer has the right to confirm or cancel the Order for the purchase of the Goods if the price is changed by the Seller after the Order is placed.
3.5. The Seller is not allowed to change the price for the Goods already paid for by the Buyer.
3.6. The Seller indicates the cost of delivering the Goods on the website of the Online Store or informs the Buyer when placing the order by the Operator.
3.7. The Buyer's obligation to pay for the Goods is considered fulfilled from the moment the funds are received by the Seller.
3.8. Settlements between the Seller and the Buyer for the Goods are made in the ways indicated on the website of the Online Store in the section "Delivery and Payment".
4.1. The Buyer can place an order for Goods through the Operator over the phone:

4.2. When registering on the Internet store's website, the Buyer agrees to provide the following registration information:
4.2.1. The Buyer's surname and first name or the recipient's surname and first name;
4.2.2. The address to which the Goods should be delivered (if delivery is to the Buyer's address);
4.2.3. An email address (not a mandatory field);
4.2.4. A contact phone number.
4.3. The name, quantity, article, and price of the Goods selected by the Buyer are indicated in the Buyer's cart on the Internet store's website.
4.4. If the Seller requires additional information, they have the right to request it from the Buyer. In case the necessary information is not provided by the Buyer, the Seller is not responsible for providing a quality service to the Buyer when purchasing goods in the online store.
4.5. When placing an order through the Operator (clause 4.1. of this Offer), the Buyer agrees to provide the information specified in clause 4.2. of this Offer.
4.6. The Buyer's acceptance of the terms of this Offer is made by entering the relevant data by the Buyer into the registration form on the Internet store's website or when placing an order through the Operator. After placing an order through the Operator, the Buyer's data is registered in the Seller's database.
4.7. The Buyer is responsible for the accuracy of the information provided when placing an order.
4.8. The remote purchase and sale agreement between the Seller and the Buyer is considered concluded from the moment of electronic order processing on the service of the Internet store's website or when the Seller issues a cash or merchandise receipt or other document confirming the payment for the Goods.
5.1. The methods, procedure, and terms of delivery of goods are indicated on the website in the "Delivery and Payment" section. The Buyer agrees on the procedure and conditions of delivery of the ordered goods with the internet market operator at the time of purchase.
5.2. Self-pickup of goods:
5.2.1. After submitting an order, the Buyer can pay and receive their goods at the following address: Kyiv, Heroes of Sevastopol Street 10, Mon-Sat from 09:00 to 20:00, Sun from 09:00 to 18:00.
5.2.2. The ownership and risk of accidental loss or damage of the goods passes to the Buyer or their Representative from the moment of receiving the goods by signing the purchase receipt and/or order (and/or instructions for purchasing and delivering the goods) for delivery.
5.3. Delivery of goods is carried out by the employees of the internet store according to the delivery conditions, or with the involvement of third parties (carrier).
5.4. Upon receiving the goods, the Buyer must check the conformity of the goods to the qualitative and quantitative characteristics (name of the goods, quantity, completeness) in the presence of the courier representative.
5.5. The Buyer or their Representative confirms by their signature in the purchase receipt and/or order for the delivery of goods that they have no claims regarding the quantity, appearance, and completeness of the goods.
6.1. The Buyer has the right to refuse the goods at any time before its transfer, and after the transfer of the goods - in the manner and on the conditions determined by the Law of Ukraine "On Protection of Consumer Rights."
6.2. The return of goods of proper quality is possible if the commercial appearance, consumer properties, and the document confirming the purchase and conditions of the order of the specified goods are preserved.
6.3. The customer is not entitled to refuse a product of proper quality that has individually-defined characteristics if the said product can only be used by the consumer who purchased it (including non-standard sizes and other characteristics requested by the customer). Confirmation that the product has individually-defined characteristics is the difference in the size and other characteristics indicated on the website.
6.4. The return of a product, in cases provided by law and this Agreement, is carried out at the address indicated on the website in the "Delivery and Payment" section.
6.5. In the event of the customer's refusal of a product of proper quality, the Seller refunds the amount equal to the cost of such product, excluding the seller's expenses for the return shipping of the product.
6.6. The return of the amount specified in clause 6.5 is carried out within 7 business days after the store receives the returned product.
7.1. The Seller shall not be liable for any damages caused to the buyer as a result of improper use of products previously ordered on the website https://www.solnyshko.kiev.ua and purchased from the Seller.
7.2. The Seller shall not be liable for improper or untimely performance of Orders and obligations in case the buyer provides inaccurate or incorrect information.
7.3. The Seller and the Buyer shall be responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement.
7.4. The Seller or the Buyer shall be released from liability for complete or partial non-performance of their obligations if such non-performance is due to force majeure circumstances, such as war or military actions, earthquake, flood, fire, and other natural disasters that occurred independently of the will of the Seller and/or the Buyer after the conclusion of this Agreement. The party that cannot perform its obligations shall immediately notify the other party of this.
